1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and BrakeCheck ("Company", "we", "us", or "our") concerning your access to and use of our automotive service management platform and related services (collectively, the "Services").

By accessing or using our Services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our Services. These Terms apply to all visitors, users, and customers of our Services.

2. Description of Services

BrakeCheck provides an automotive service management platform that enables:

  • Scheduling and management of automotive brake inspection and service appointments
  • Customer account management and vehicle registration
  • Service history tracking and work order documentation
  • Communication between customers and service technicians
  • Access to vehicle specifications via VIN decoding services

Our Services are operated in the Province of Ontario, Canada and are subject to Ontario law.

3. User Accounts

3.1 Account Registration

To access certain features of our Services, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and update your information to keep it accurate
  • Keep your password confidential and secure
  • Accept responsibility for all activities under your account

3.2 Account Security

You are responsible for maintaining the security of your account. You must immediately notify us of any unauthorized use of your account or any other security breach. We are not liable for any loss or damage arising from your failure to protect your account.

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms, fraudulent activity, or at our sole discretion. You may request account deletion through your account settings or by contacting us.

4. User Responsibilities

As a user of our Services, you agree to:

  • Use our Services only for lawful purposes and in accordance with these Terms
  • Provide accurate vehicle information when booking services
  • Attend scheduled appointments or cancel with reasonable notice
  • Not attempt to gain unauthorized access to any part of our Services
  • Not interfere with or disrupt the integrity or performance of our Services
  • Not use automated systems or scripts to access our Services without authorization
  • Not attempt to probe, scan, or test the vulnerability of our systems
  • Not transmit any malicious code, viruses, or harmful content

5. Appointments and Services

5.1 Booking Appointments

When booking an appointment, you agree to provide accurate information about your vehicle and service needs. Appointment availability is subject to technician schedules and bay availability.

5.2 Cancellation and Rescheduling

You may cancel or reschedule appointments through your account. We recommend providing at least 24 hours notice for cancellations. Repeated no-show appointments may result in restrictions on future bookings.

5.3 Service Completion

All automotive services are performed by qualified technicians. Service times are estimates and may vary based on vehicle condition and additional issues discovered during inspection. We reserve the right to refuse service if a vehicle presents safety hazards or if the requested service is not appropriate for the vehicle.

6. Vehicle Information and VIN Decoding

Our Services utilize the NHTSA vPIC API to decode Vehicle Identification Numbers (VINs) and retrieve vehicle specifications. You agree to:

  • Provide accurate VIN information for your registered vehicles
  • Acknowledge that decoded vehicle data is sourced from NHTSA and may not reflect aftermarket modifications
  • Understand that VIN decoding is provided for informational purposes and does not guarantee vehicle condition

7. Intellectual Property

All content, features, and functionality of our Services—including but not limited to text, graphics, logos, software, and design—are owned by BrakeCheck and are protected by Canadian copyright, trademark, and other intellectual property laws.

You may not:

  • Copy, modify, or distribute any content from our Services without authorization
  • Use our trademarks, logos, or branding without written permission
  • Reverse engineer, decompile, or attempt to extract the source code of our platform

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRAKECHECK SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, use, goodwill, or other intangible losses
  • Damages resulting from unauthorized access to your account or data
  • Damages resulting from third-party actions or service interruptions
  • Damages resulting from your use or inability to use our Services
  • Errors or inaccuracies in vehicle data obtained from third-party sources

In any event, our total liability for any claim arising from or related to these Terms or our Services shall not exceed the amount you paid us for the specific service giving rise to the claim, or $100 CAD if no payment was made.

9. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING:

  • Warranties of merchantability, fitness for a particular purpose, and non-infringement
  • Warranties regarding the accuracy, reliability, or completeness of any content
  • Warranties that our Services will be uninterrupted, error-free, or secure
  • Warranties regarding the correction of defects or errors

Some jurisdictions do not allow the exclusion of certain warranties. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

10. Indemnification

You agree to indemnify, defend, and hold harmless BrakeCheck and its officers, directors, employees, agents, and affiliates from and against any claims, damages, obligations, losses, liabilities, costs, and expenses arising from:

  • Your use of our Services
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your violation of any applicable laws or regulations

11. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada, without regard to conflict of law provisions.

Any dispute arising from these Terms or our Services shall be resolved exclusively in the courts of the Province of Ontario, Canada. You consent to the jurisdiction of such courts and waive any objection to venue.

12. Dispute Resolution

In the event of a dispute, you agree to first attempt to resolve the matter informally by contacting us at the email address provided below. If the dispute remains unresolved after 30 days, either party may pursue legal remedies in accordance with Section 11.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. Material modifications will be communicated through our Services or by email to registered users. Continued use of our Services after modifications constitutes acceptance of the updated Terms.

We encourage you to review these Terms periodically. The "Last Updated" date indicates the most recent revision.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and BrakeCheck concerning your use of our Services and supersede any prior agreements or understandings.
